2 PARAGRAPHS 4 LIBERTY: #264 “BEST WISHES DR. JO!”

Well, my life became much less complicated this past weekend because I did not receive the nomination of the Libertarian Party for President.  Instead the nomination went to Dr. Jo Jorgensen, who is an instructor at Clemson University.  My great team was sensational, and I believe my running mate, Larry Sharpe of New York, and I successfully got our message out.  But that was not what the delegates wanted.  Of course we believe they made a mistake, but they had every right to make it.  (You can make up your own minds using this link for the video clip of my nominators’ and my presentations to the delegates in the virtual national convention: https://vimeo.com/421983993.)  But now Onward: please join me in congratulating and supporting Dr. Jo as she carries the banner of Liberty forward – for all of us!

Among other things, for me “onward” means that we all should focus this Memorial Day weekend upon the fact that it is our government, and if it isn’t working we have no one to blame but ourselves.  So in that spirit, here are the lyrics of the song You Are The We.  This is the encore to my new musical Convention: the Birth of America.  The song is first sung by George Washington and our moderator Benjamin Franklin and then, increasingly, the entire cast.  What do you think?  I wish you a Happy and Thoughtful Memorial Day Weekend!

They say you like to call us Founding Fathers,
Our portraits are still in your history books.
To that we’d like to say we’re deeply honored,
And glad to see the artists captured our good looks.

But if we’re your Fathers, you’re our sons and daughters,
With some greats and grands appended that’s for sure.
And though we never met you, we knew you’d be coming along some day,
So we wrote this Constitution to keep you safe and strong the American Way:

Keep it alive, see that it thrives, and pass it along again.
But open your eyes, you have to be wise,
You have to be strong and then:

Teach your children well, maybe even tell them
Of our Founding Fathers, how their sons and daughters
Carried it through a hundred or two perilous years to hand it to you:

For now you . . . you are the People
It’s you . . . you are the We.
It’s yours, your Constitution,
It belongs to you and me.

Yes you . . . you are the People,
It’s you . . . you are the We.
It’s yours, your Constitution,
For this Land of the Free.

Carry it forward, carry it on.
Protect and defend it, in keeping it strong.
And when there is weakness, amend if you must,
But harbor no meekness defending this Trust.

For you . . . you are the People,
It’s you . . . you are the We.
It’s yours, your Constitution
For this Land of the . . . Free!

2 PARAGRAPHS 4 LIBERTY #259 "WE ARE ANNOUNCING!"

Last Friday I filed my notice of running for the nomination by the Libertarian Party as it’s candidate for President of the United States.  Today’s atmosphere of polarization, name-calling and tribalism  is simply unacceptable to me, and I anticipate it is to you as well, so we simply must have another choice in addition to Donald Trump or Joe Biden.  What follows below is the announcement I am sending to the voting delegates of the Libertarian Party.  I would appreciate all of your comments, reactions and support during the coming months because, together, we can Unite America by representing all of the people!  So here it is:

Hello, my name is Judge Jim Gray, and I am seeking the nomination as the Libertarian candidate for President, along with our friend and Libertarian stalwart Larry Sharpe from New York as my running mate for Vice President.  I am proud of my background as a Peace Corps Volunteer in Costa Rica, because I care about people; a Navy JAG officer, because I care about our military and our security; a federal prosecutor in Los Angeles , who knows that all prosecutors in the name of “We the People” should always do the right thing for the right reason; and a trial court judge for 25 years, where I put my professional future at risk by holding a press conference back in 1992 emphasizing the reality that our nation’s policy of Drug Prohibition simply was not working.
I’m sure you agree with me that Big Government is really good at one thing, and that is increasing the size, cost and power of Big Government.  That must be reversed.  I also expect that you agree that our federal government recently simply failed us by not being prepared for emergencies.  Yes, they don’t know when or where disasters might strike, such as earthquakes, hurricanes or pandemics, but it is their obligation previously to have made plans and have them in place when those disasters strike.  If the government hasn’t planned, then it is too late when the disasters occur.  Instead the government’s response was to shut down the economy.  But they did this without considering the additional disasters that will be inflicted upon us all by often unnecessarily closing probably hundreds of thousands of businesses, many which will never open again, and putting tens of millions of people out of work!  And we all will feel those government-inflicted damages for many years to come!
To “remedy” these problems the government did something that it does best, which was to throw a great amount of money -- $2.2 Trillion –  at some businesses and people, while often arbitrarily leaving others out in the cold.  (For example, the Kennedy Center received about $15 million.  Why?  “Because it was hurt by being shut down!”  But what about the other theaters all across the country that were hurt as well?  Nothing for them!  And, of course, these payments added greatly to our national deficit, which is the largest security threat to our country, as well as the economic future of our children, grandchildren and even great grandchildren who will have to pay it back!  Libertarians are the only political party that speaks out consistently and forcibly on this critical issue.
Furthermore, we must follow our Constitution and our laws by requiring a Declaration of War from Congress before authorizing our troops to be in combat for more than 60 days.  (At this point, what really are the goals our troops are fighting for in Afghanistan?), and let’s also bring competition back to our healthcare system, which will reduce costs and increase services, as well as our educational system, which will bring back excellence to many schools that today are failing our children!
Long ago Thomas Jefferson said that “We should have a bloody revolution every generation to keep the vested interests at bay.”  Fortunately, our Constitution keeps the revolution from being bloody, but when was the last political revolution?  Probably in the early 1860s when the Republicans took over from the Whigs.  And look at how entrenched those vested interests have become since that time.
You can help!  Please visit www.GraySharpe2020
Join us!  Support us!  Together we will be that revolution!
We Pledge Allegiance to the Constitution of the United States of America!
And all along the way, we will do you proud!

Thought for the week:  My great wife, Dr. Grace Walker Gray, DPT, DOT, has just published a book in hard and soft cover as well as in audio entitled BYE-BYE BACK PAIN: 9 Holistic Solutions for Relief from Sciatica, Lumbago, Slipped Disc and Backache, which is available through Amazon and elsewhere.  Other than the back pain inflicted by too many government excesses, it covers virtually everything we need to know about controlling the back pain that we all get as we grow older.  Get a copy, and I feel confident that her advice will help you a great deal with this problem. Here is the link: https://www.amazon.com/Bye-Bye-Back-Pain-Holistic-Solutions/dp/1734288418/ref=sr_1_2?dchild=1&keywords=bye+bye+back+pain&qid=1587232003&sr=8-2 . Leave her a 4 or 5 star review. I did!

2 PARAGRAPHS 4 LIBERTY: #248 "RESPECT THE PROCESS!"

Many people have complained that President Trump has wrongly set aside some of President Obama’s “good works” regarding things like DACA, which has kept people who were brought into our country as small children without complying with our immigration laws from being deported.  But the problem does not lie with Trump, it actually lies with Obama and Congress.  Why?  Because Mr. Obama issued Executive Orders for our laws not to be enforced for those young people.  So, that being the case, no one has a legitimate complaint when Trump similarly issues Executive Orders counteracting them.  However, if President Obama had respected the process and successfully attempted to have the immigration laws changed, President Trump would have been forced to follow suit.  (What’s good for goose also good for gander. . .)
In other words, the process is critically important.  We don’t have dictators in our country who can rule by fiat.  The DACA issue to me is clear: we should keep those young people who have adapted well into our society here – and I believe most Americans would agree with that result.  So if I were in Congress, I would vote for the modification of our immigration laws to enact that result.  But this is yet another example of Congress abrogating its lawmaking responsibilities to a president.  Another huge example is Congress’ having passed the so-called War Powers Acts that have allowed presidents, in effect, to declare war on other nations or peoples.  No, Constitutionally only Congress can declare war!  Of course our laws still allow a president to respond to an immediate threat.  But otherwise it is meaningless for a country to be based upon the Rule of Law if its elected officials don’t respect the process– and these failings are laid at the feet of Congress!

2 PARAGRAPHS 4 LIBERTY: #241 "AN ANTIDOTE TO POLARIZATION"

Our society is now more polarized than at any time of my life.  Why has that happened?  Two reasons come to mind.  Originally, when cable television news stations began to multiply I thought that it would be great because, with so many choices, all of us would be exposed to many more viewpoints – which would be healthy.  And boy was I wrong!  Instead, each station deciphered what the political leanings were of its target audience, and then expressly catered to what that audience wanted to hear.  So we are the good guys, and people who do not have our beliefs are scoundrels or worse.  A second reason is the gerrymandering of the congressional voting districts.  “I don’t care if you of the opposite party get a politically safe seat as long as I can get one too” has become the position of those drawing up voting districts.  And this has allowed many members of Congress to take some radical positions without being held accountable to the views of more moderate voters.  Both of these situations have allowed polarization to flourish.*
And there is also a third reason as well.  Thomas Jefferson famously said that our country should have a bloody revolution each generation in an attempt to keep the vested interests at bay.  Fortunately our Constitution keeps the revolution from having to be bloody, but how long has it been?  Probably since the 1860s when the Republicans took over from the Whigs.  And how strong have the vested interests become in that time?  Strong enough for many people to believe that our institutions are no longer working.  “The Presidency doesn’t even try to represent all of the people,” “Congress is working against us,” and even “The Courts are only providing ‘justice’ to the wealthy” are conclusions that many people have reached.  And this situation has resulted in us being so polarized.  So what is the antidote?  Voting Libertarian!  It is not an exaggeration to say that Libertarians are the only mainstream political party in our country today.  We believe in financial and other responsibility at all levels of society, including personal, group, corporate and governmental.  And we are socially accepting with a “Live and Let Live” philosophy.  In addition, Libertarians are the only political party that does not seek to gain by being involved in government.  Thus we would strongly reduce the crony capitalism or corporate welfare that is rampant in our governments today.  So do you want an antidote for polarization, and to be proud of your votes at the same time?  Consider voting Libertarian.

-->
*As an anecdote, in my research in composing a musical about our nation’s 1787 Constitutional Convention entitled “Convention: the Birth of America,” I learned that one of the delegates was named Elbridge Gerry, who later became the Governor of Massachusetts and was also the Vice President under James Madison.  But he also was so well known for his politics in drawing the boundaries of voting districts for political purposes that the practice soon took up his name, and it still does to this day.

2 PARAGRAPHS 4 LIBERTY: #235 "OUR LIBERTIES: THE SOUL OF AMERICA"

During World War II many of our troops who were being held as prisoners of war were tortured by the Japanese.  I understand that one of the things that kept our troops’ morale up during these ordeals was the strong belief that, if the situation would have been reversed, we would not torture them.  Why ?  Because we were better than that!  And that is one of the bases of American Exceptionalism.  But are we that way today?  Many terrorists around the world argue that, although we profess to be more pure, we are not.  And they invariably cite to our “state secret” laws that prevent people who claim they were tortured by our CIA or its agents from pursuing law suits in our courts against our federal government.
What is the actual situation?  Few of us know – or even think about it – because it is out of the news. Wrongly so, in my opinion, because this strongly affects who we are.  And if we are torturing people for any reason whatsoever, We the People should be aware of it.  Of course, reasonable people can differ as to what constitutes torture, and the circumstances in which it can be used.  But regardless of how that discussion is resolved, that still does not address the State Secrets Act.  To further bring this issue into focus, Erwin Chemerinsky, Esq., the dean of the Law School at the University of California, Berkeley, has set forth his findings in a book entitled Closing the Courthouse Door: How Your Constitutional Rights Became Unenforceable.  And his message is disturbing.  He writes convincingly that our government is torturing people in our names to “protect” our national interests, but without being forced to show in court that state secrets would actually have to be revealed if a trial were to go forward.  In other words, since our Liberties are the soul of our great country, our soul is under attack by our very own government!  How do you think that would make our troops from Japanese prison camps feel?

2 PARAGRAPHS 4 LIBERTY: #231 "HARM REDUCTION"

According to President Nixon’s Attorney General Richard Kleindienst, back during the Nixon Administration the choice was made to pursue an incarceration approach to drug problems instead of one involving treatment, even though they knew that treatment worked and incarceration did not.  Why was this done?  Because Nixon anticipated that the political benefits he would reap in being perceived as being “tough,” and fighting against something that could not fight back, would be significant.  And, again according to Keindienst, the actual political benefits were far greater than anyone anticipated.  But we all have been saddled with many tragic results from that choice ever since that time.
Of course, the presence of mind-altering and sometimes addicting drugs in our society brings harms.  But reasonable estimates are that the drug usage itself brings only about 10 percent of those harms.  The other 90 percent comes from the drug money.  In addition, since no society has ever been without some of these substances, except maybe the Eskimos because they couldn’t grow anything, we should recognize as adults that harms will result from the presence of those drugs – and invoke a policy to reduce those harms.   Think of it this way: we can’t even keep these drugs out of our prisons, so how can we expect to keep them out of our communities?  (Charles Manson was transferred from one California state prison to another because he was found to be selling drugs from his prison cell – and he was in solitary confinement!)  And since, as stated above, one of the approaches that works is drug treatment, which also includes overdose prevention and care and needle exchange programs, those approaches should be emphasized.  (The old saying is that dead addicts can’t recover.)  Of course, this approach includes enforcement through some incarceration for those whose addictions push them into criminal conduct, such as driving under the influence, burglaries to get money to purchase drugs, etc.  So please use your Liberty and actions to help us steer away from the mindless incarceration of drug users we have followed since the Nixon Administration.

2 PARAGRAPHS 4 LIBERTY: #228 "THE LIBERTY TO SEE THE USA!"

My wife Grace and I have spent the last ten days on a trip first to Portland, and then on a cruise on the Columbia and Snake Rivers (which explains why you did not receive last week’s edition of this series).   We have such a rich and interesting history here, like what we saw and envisioned with the Lewis and Clark Expedition, so why go anywhere else?  As a result, this week’s edition simply recommends that all of us often take time to pause and reflect how truly fortunate we are to be who we are, live where we live and have what we have.  We are genuinely blessed – and all the more so if we appreciate that fact.
Among my blessings is the fact that I have been able to travel the world quite extensively – but there is nowhere more interesting or beautiful than our US of A!  Most of us actually have the Liberty to be able to go where we want – no walls with the barbed wire fences facing inward instead of outward like were present in East Germany and now are in North Korea!  But I recommend we more often use that Liberty to see the beautiful places in our great country.  No passports, no changes of currency – and many times no changes of time zones.  Good stuff!  So why go anywhere else?

My favorite Winston Churchill story:  Frequently before he would give a speech, Churchill would go to the men’s room to relieve himself so he would not be uncomfortable during his presentation.  But it happened that one time he was doing just that at a urinal when his political nemesis, Clement Attlee, came in right beside him.  So when Churchill stopped doing his business and moved over to one urinal away, Attlee said to him “You’re getting a bit prudish in your old age aren’t you Winston?”  To which Churchill responded: “Clement, I know you, and any time you see something that is big, private and works well, you want to nationalize it.”

2 PARAGRAPHS 4 LIBERTY: #225 "FREE TRADE ENRICHES US ALL"

Because of my research for our new musical “Convention: the Birth of America,” which is about the 1787 Constitutional Convention, I have become quite familiar with the beliefs of our Founders.  And one of those beliefs, which was enshrined in Article I, sections 9 and 10 of our Constitution, was that there would be no tariffs imposed on trade between or among the states.  Can you imagine the harmful effect it would have had if, for example, Virginia had been able to have imposed tariffs for goods it imported from Maryland?  Such tariffs would have been deeply destructive to our nation’s economy.  As a result, Virginia, Maryland and all of the other states since that time have been able to focus upon what they did best, and also derive the benefit of receiving goods and services from other states that were derived from what they did best as well.  And this accrued to everyone’s benefit.
But today it is far easier for businesses in our country to trade with China, India, Germany or any other country than it was for Maryland to trade with Virginia in the 18thCentury.  And trade barriers among countries have the same effect as they would have had among our states.  So let China, Mexico, Japan and Indonesia focus upon what they do best, and let our consumers here benefit by being able to purchase high quality products for reasonable competitive prices from those countries. All the while the businesses in our country will be able to focus upon what they do best, with the same result.  And, besides, this will also bring numerous other additional benefits.  For example, countries have a deep tendency not to go to war with their own customers, so this will reduce military strife.  And if the people in Mexico, Guatemala and Indonesia are better able to profit from producing goods in their own countries, their economy will be stronger, with the result that not so many people will feel the necessity to emigrate from their country to ours.  So, once again, Liberty works!
The two best signs in my memory that were held up by fans at sporting events:  First, I was listening to a Dodgers’ broadcast on opening day in about 1962 from Shea Stadium in New York when the Mets were not playing good ball when Vin Scully started laughing on the air.  He then explained that he saw a fan holding a sign up in the right field bleachers that said: “Wait Til Next Year!” And this was on opening day!  The second was at a UCLA Basketball game, when a young man stood up in his seat while holding a big sign then said: “The People Behind Me Can’t See.”

2 PARAGRAPHS 4 LIBERTY: #223 "WHO BEST SETS PRICES?"

Maybe I have been somewhat remiss in this series by not speaking enough about why the Free Market System tends to be so successful.  Of course, it is based upon free choice, private property rights and incentives.  But probably the most important aspect of this successful system is that it sets prices at a rate that both the buyers and sellers agree upon.  If not, the products and services won’t sell, so adjustments will be made.  In a socialistic system, the prices are set by central planners, who have little incentive to learn about, much less respond to, the needs and demands of the consumers.  So who is in a better position to decide how many red cars or electric cars or flat screen televisions to manufacture and at what price, a seller whose business relies upon successful sales, or a bureaucrat?  Everyone will – or at least should – agree that the manufacturer is better placed and motivated.
China still has government control over many manufacturing businesses, but has been increasingly successful since the death of Mao Zedong in allowing individuals within the companies to make those business decisions.  Otherwise, virtually every other place that has ever tried to have manufacturing and pricing decisions made by central planners has ended up in misery, if not starvation.  So why do we not celebrate the Free Market System more fully and broadly?  Because people like us tend to be quiet when other people who get carried away by emotion sing the praises of socialism.  Literally, they don’t know what they are talking about.

2 PARAGRAPHS 4 LIBERTY: #220 "A P"

Historians tell us that poverty was the pervasive norm all around the world before the Industrial Revolution.  Before that remarkable achievement, most people lived off the land, and if their crops failed they often starved to death.  In addition, there was little clean water and less sanitation for sewage, disease was rampant, and giving birth was a dangerous situation for both mother and child.  That situation began to change with the Industrial Revolution, which resulted in more people moving into cities, gradually having refrigerated and canned food to eat, more safety slowly coming to the workplace, diseases beginning to be more understood and addressed, and generally people’s lives becoming safer, healthier and longer.  Of course, poverty in the 1800s and 1900s still widely existed, but the quality of life for those in poverty was demonstrably higher.
So what does poverty look like today?  Most people at least in our country have a roof over their heads, indoor plumbing with clean running hot and cold water, enough food to eat, a cell phone and a color television set, access to emergency medical care, and their children get free K-12 education, along with a free lunch when needed.  Yes, there still is often found a wide disparity between the wealthy and the poor, and that doesn’t address the plight of the homeless,* but the life of the poverty-stricken today is far better than that of most of the wealthy people of the 16th Century.  Of course, that does not mean that people of good will should not continue their efforts today to help the poor, but everyone, including the poor, should also keep a perspective about what poverty today truly is.  Far better to live now than before the Industrial Revolution – which was brought to us by the Free Enterprise System along with Private Property Rights.  Without those highly successful approaches, many of us would probably be starving right now.

*As previously stated in these pages, I suggest the homeless issue be addressed institutionally, instead of occasionally having governments throw money at it, by having a safety net for every adult citizen and holder of a green card in our country, which would consist of a monthly stipend of a certain amount of money – except for those who truly have special needs.  Then we could abolish all other welfare systems and let the Free Market take over from there.
